Terms of Service
These terms govern your use of CommunityCare. By creating an account or using the platform you agree to them.

1. What CommunityCare is
CommunityCare is a care-coordination platform. It allows a patient's family, carers, and clinicians to share daily care observations and routine record-keeping in one place. The platform is provided by CommunityCare (the "Service Provider", "we", "us"). Company entity and registration details are published at incorporation.
2. What CommunityCare is not
- Not a medical device. CommunityCare does not diagnose, treat, monitor, predict, or replace any clinical judgement. Any alerts the platform surfaces are configurable reminders based on user-set thresholds. Treat them as task prompts, not clinical interpretations.
- Not an emergency service. If a patient's life is at risk, call your local emergency number. Do not rely on the platform to escalate.
- Not a substitute for the patient's medical record. Where a GP practice maintains a separate clinical record system (PMS, EHR), that remains the primary source of truth for clinical decisions.
3. Your account
- You must be 18 or older to create an account, or supervised by an adult who is.
- You're responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at security@community-care.app if you suspect compromise.
- You must provide accurate information about your role (GP / org admin, caregiver, family member). Misrepresenting your role to obtain access to records you are not authorised to see is a material breach of these Terms.
- You consent to our Privacy Policy when you create an account.
4. Acceptable use
- Do not add a patient's data unless you have a legitimate care reason and the appropriate consent (from the patient, or, for minors and incapacitated adults, from their legal representative).
- Do not impersonate another user, harass any user, or use the platform for unlawful purposes.
- Do not attempt to access records you are not authorised to see, circumvent security controls, scrape data, or interfere with the platform's normal operation.
- Do not upload malicious code, infringing content, or content unlawful in the jurisdiction you are using the platform from.
- Do not share aggregate exports of patient data with third parties without a lawful basis and the necessary consents.
We may suspend or terminate accounts that breach these rules, and may disclose activity logs to regulators or law enforcement where required by law.
5. The DPA between us and GP practices
Where a GP practice ("Customer") uses CommunityCare to manage records about its patients, the Customer is the data controller (UK GDPR) / responsible party (POPIA) for those records and CommunityCare is the data processor / operator. The Data Processing Agreement (DPA) — available at /legal/dpa-template — governs that relationship and is incorporated into these Terms by reference. Where any conflict exists between these Terms and the DPA, the DPA prevails for personal information processing matters.
6. Subscriptions and billing
GP subscriptions are billed monthly or annually in the currency offered for your region (currently ZAR, PHP, GBP). During an early-access period the service is free; prices set at general availability launch will be applied with at least 30 days' written notice.
Family members and primary caregivers use the platform at no charge to the family, within the per-patient seat allowance set out on the pricing page. Optional add-ons are billed to the family separately via Stripe.
We use Stripe to process payments. Stripe's terms apply to payment transactions in addition to ours.
7. Past-due accounts
If a billing payment fails, your account is moved to past due and we notify the org admin by email. You have 14 days to update payment details. After 14 days we may suspend write access until payment is resolved; we will not delete records during a past-due grace period. After 60 days of continuous non-payment we may cancel the subscription per Section 9.
8. Service availability
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance is announced in advance. We may make changes to features with reasonable notice. Material changes that materially reduce functionality you rely on will be announced at least 30 days in advance.
9. Cancellation and data return
You may cancel at any time. After cancellation:
- For 30 days, you can export all your data via the in-app Export function or by emailing privacy@community-care.app.
- After 30 days, account access is suspended. We retain records for the periods stated in our Privacy Policy (typically 6–7 years for clinical records, where required by law).
- You may file an erasure request at any time before or after cancellation, subject to overriding retention obligations described in the Privacy Policy.
10. Limitation of liability
To the maximum extent permitted by law:
- CommunityCare is provided on an "as is" and "as available" basis.
- We are not liable for any clinical decision made by any user, nor for the consequences of any decision to act or not act on information shown by the platform.
- We are not liable for losses you could have avoided by following reasonable instructions from us (including security advice).
- Our total aggregate liability arising out of or relating to these Terms or the platform is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) £100 / R2,000 / ₱5,000 (whichever applies to your region).
- Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded.
11. Suspension and termination
We may suspend or terminate your account immediately if you breach these Terms, if continued provision of the service would expose us to legal risk, or if your account is past due for more than 60 days. We will give reasonable notice where possible and the opportunity to remedy a curable breach.
12. Governing law and disputes
For users in South Africa, these Terms are governed by the laws of South Africa and disputes are subject to the non-exclusive jurisdiction of the South African courts. For users in the Philippines, the laws of the Republic of the Philippines apply. For users in the United Kingdom or any other jurisdiction, the laws of England and Wales apply. Local consumer protection laws that grant additional rights to you in your jurisdiction continue to apply where they are more favourable than these Terms.
13. Changes
We may update these Terms. Material changes will be notified by email at least 30 days before they take effect. Continued use after that date constitutes acceptance.
